General Terms and Conditions (AGB)

1. Scope of Application
These General Terms and Conditions (the "Terms") apply to all contracts concluded between Cafe Mijito (Hardenbergstraße 12, 31141 Hildesheim, Germany) and a consumer (the "Customer") via the online store at www.mijitocoffee.com. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
2. Conclusion of Contract
2.1 The presentation of our products in the online store does not constitute a legally binding offer, but rather a non-binding online catalog.
2.2 By placing an order via the "Buy Now" or "Order with obligation to pay" button, you are making a binding offer to purchase the goods in your shopping cart. The confirmation of receipt of your order will be sent immediately after the order is placed by an automated email. This email does not yet constitute acceptance of the contract.
2.3 The contract is concluded when we accept your order by sending a separate order confirmation via email. This order confirmation will also contain a copy of these Terms and a summary of your order.
3. Prices and Payment
3.1 All prices listed on our website are in Euro (€) and include the statutory German Value Added Tax (VAT).
3.2 Shipping costs are not included in the product price and will be clearly stated before you complete your order.
3.3 We offer various payment methods. You will be informed of the available payment options during the checkout process.
4. Shipping and Delivery
4.1 The delivery time depends on the shipping method and destination. Estimated delivery times are provided on the product pages and during the checkout process.
4.2 We ship our products to the delivery address provided by the Customer.
4.3 The risk of accidental loss and deterioration of the goods passes to the Customer upon handover of the goods to the shipping carrier. This does not apply if the Customer is a consumer; for consumers, the risk of accidental loss and deterioration of the sold goods passes to the Customer only upon delivery of the goods to the Customer.
5. Right of Withdrawal (Widerrufsrecht)
5.1 As a consumer in the European Union, you have a statutory right of withdrawal. You can find detailed information about this right, including exceptions and a model withdrawal form, in our separate Return and Refund Policy.
5.2 Please note that the right of withdrawal does not apply to contracts for the delivery of goods that are perishable or whose expiration date would be exceeded quickly, such as our roasted coffee, once the original, sealed packaging has been opened.
6. Warranty (Mängelhaftung)
6.1 The statutory warranty rights apply to all our products.
6.2 If a product is defective upon delivery, you have the right to demand supplementary performance (either repair or replacement) in accordance with statutory provisions. If supplementary performance fails, you may be entitled to a reduction in the purchase price or to withdraw from the contract.
6.3 Please contact us at info@mijitocoffee.com if you receive a defective or incorrect item. We will work with you to resolve the issue as quickly as possible.
7. Liability
7.1 We are liable for damages caused by intent or gross negligence.
7.2 We are also liable for the negligent breach of essential contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper execution of the contract and on the fulfillment of which the Customer may regularly rely. In this case, our liability is limited to the foreseeable, typical damage.
7.3 The above limitations of liability do not apply to damages resulting from injury to life, body, or health.
7.4 We are not liable for slight negligence of non-essential contractual obligations.
8. Online Dispute Resolution and Consumer Conciliation
8.1 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
8.2 We are not obligated or willing to participate in a dispute settlement procedure before a consumer arbitration board.
9. Copyright and Trademarks
9.1 The content of this website, including but not limited to texts, graphics, logos, images, and software, is our property or the property of our content suppliers and is protected by German and international copyright law.
9.2 Our trademarks may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.
10. Final Provisions
10.1 The laws of the Federal Republic of Germany apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the Customer is a consumer, this choice of law applies only to the extent that it does not deprive the consumer of the protection provided by mandatory provisions of the law of the state of the consumer's habitual residence.
10.2 If any provision of these Terms is invalid, the validity of the remaining provisions shall not be affected. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
10.3 The place of jurisdiction for all disputes arising from or in connection with these Terms is our registered office in Hildesheim, Germany, provided the Customer is a merchant, a legal entity under public law, or a special fund under public law.
